This U.S. Privacy Notice (“Notice”) applies to personal information collected by FOOD & LIFE COMPANIES LTD. and its affiliated companies operating restaurants and related services in the United States, including through their U.S.-based restaurant operations and affiliated entities (collectively, “FOOD & LIFE,” “we,” “our,” or “us”).
This Notice supplements the FOOD & LIFE COMPANIES LTD. Privacy Policy (https://food-and-life.co.jp/en/privacy-policy/) (the “Global Policy”) and applies to U.S. restaurant operations, including but not limited to current and planned restaurant operations in New York and Massachusetts, U.S. affiliated entities, websites, mobile features, reservation systems, promotional activities, in-store games and entertainment features, loyalty or membership programs, and related services (the “U.S. Operations”). Where this Notice conflicts with the Global Policy, the Notice controls for U.S. Operations.
This Notice explains:
what personal information we collect;
how we use and share personal information;
your choices and rights regarding personal information; and
additional information required under certain U.S. state privacy laws, including California law.
Depending on how you interact with us, we may collect the following categories of personal information:
Information You Provide Directly:
name;
email address;
telephone number;
mailing address;
reservation information;
customer service inquiries;
marketing preferences;
survey responses;
contest or promotion participation information;
information relating to in-store games or promotional activities;
payment-related information; and
other information you voluntarily provide.
Information Collected Automatically:
IP address;
browser type;
device identifiers;
operating system;
approximate location information;
pages visited;
referring URLs;
website usage activity;
advertising interactions; and
cookie or tracking information.
In-Store and Security Information:
Our restaurants may use:
security cameras;
customer traffic analytic tools;
digital ordering systems; and
entertainment, promotional, or customer engagement game-related systems.
We may use personal information for the following purposes:
operating restaurants and providing services;
processing reservations, orders, and transactions;
customer service and responding to inquiries;
providing promotions, discounts, newsletters, and marketing communications;
administering contests, events, campaigns, or in-store games;
improving our restaurants, services, websites, and customer experience;
analyzing customer interests and usage trends;
fraud prevention, security, and safety purposes;
maintaining and improving website functionality;
complying with legal obligations; and
other legitimate business purposes permitted by law.
We will not use personal information for materially different, unrelated, or incompatible purposes without providing notice consistent with applicable law.
If you register for marketing communications, we may send promotional emails, newsletters, restaurant updates, special offers, surveys, and event information.
You may opt out of marketing emails at any time by:
clicking the unsubscribe link included in the email; or
contacting us using the information below.
Opt-out may take a reasonable time to process. Even if you opt out of marketing communications, we may still send service-related or transactional communications where permitted by law.
We may use cookies, pixels, web beacons, analytics tools, and similar technologies to:
operate and improve our websites and services;
understand how customers use our websites;
personalize customer experience;
measure advertising effectiveness;
provide promotional content; and
improve security and website functionality.
We may use third-party analytics and advertising providers, including Google Analytics and similar technologies.
You may control cookies through browser settings or available opt-out tools. Please note that disabling cookies may affect certain website functionality.
We may share personal information with:
affiliated companies within the FOOD & LIFE COMPANIES group;
restaurant operators and franchise entities;
reservation system providers;
payment processors;
payment card processing service providers;
marketing and email service providers;
website hosting and IT providers;
analytics and advertising providers;
game or promotional event vendors;
parties involved in an actual or proposed merger, acquisition, financing, restructuring, sale of assets, or similar business transaction;
professional advisors; and
other service providers assisting us in operating our business.
When we disclose personal information to service providers, contractors, and other vendors that process personal information on our behalf, we do so for limited and specified business purposes and require that the personal information be used in a manner consistent with our obligations under applicable law. We may take reasonable and appropriate steps to help ensure that personal information we disclose is used consistent with those obligations, and, upon notice as appropriate, to stop and remediate unauthorized use of personal information.
We implement reasonable security procedures and practices appropriate to the nature of the information and the risks presented by the processing. However, no security system is completely secure, and we cannot guarantee absolute security. We retain personal information only for as long as reasonably necessary for business, legal, operational, security, or compliance purposes, taking into account the nature of the information and the purposes for which it was collected.
Our websites, services, and in-store activities are not directed to children under 13 years of age.
We do not knowingly collect personal information from children under 13 without appropriate consent.
Depending on your state of residence and applicable law, you may have rights regarding your personal information, including the right to:
request access to personal information;
request correction of inaccurate personal information;
request deletion of personal information;
request information regarding categories of personal information collected, disclosed, or shared; and
opt out of certain targeted advertising or sharing activities.
We may need to verify your identity before processing certain requests. If we cannot verify your identity, we may deny the request or request additional information.
If you submit a verifiable request to correct inaccurate personal information, we will use commercially reasonable efforts to correct the inaccurate personal information as directed by you, taking into account the nature of the personal information and the purposes of our processing.
This section applies to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”). We do not sell personal information in exchange for monetary compensation. We do not use or disclose sensitive personal information for purposes other than those permitted by applicable law. However, certain website analytics or advertising activities may be considered “sharing” under California law.
California residents may request:
access to personal information;
correction of inaccurate personal information;
deletion of personal information; and
information regarding our collection, use, disclosure, or sharing practices.
Further, California residents have the right to request that we correct inaccurate personal information that we maintain about them. If we receive a verifiable request to correct inaccurate personal information, we will use commercially reasonable efforts to correct the inaccurate personal information as directed by the consumer, taking into account the nature of the personal information and the purposes of processing.
Some web browsers may transmit “Do Not Track” signals. Because there is not currently a universally accepted standard for responding to such signals, our websites may not respond to all Do Not Track signals.
Personal information may be transferred to and processed in countries outside your state or country of residence, including Japan. We take reasonable measures designed to protect personal information in accordance with applicable law.
We may update this Notice from time to time. Any updates will become effective upon posting unless otherwise required by applicable law.
